A escolha do tema revela-se pertinente e atual, sobretudo no contexto de uma possível revisão constitucional, oportunidade em que se pode contribuir, ainda que modestamente, para o debate e o aprimoramento do sistema jurídico nacional. O objetivo geral deste estudo consiste em analisar a possibilidade de responsabilização civil do Estado em decorrência de omissão legislativa imputável ao poder legislativo. Metodologicamente, recorreu-se à pesquisa documental, com consulta a vasta bibliografia e a documentos pertinentes ao tema. There are several presuppositions pointing to the weaknesses of the previous education systems, namely, the primary education, the basic education and the intermediate education. The consequence is a poor quality of students at the Universities. Some authors go further saying that the situation is worsened by the existence of diversity and mismatch of the curricula the failure of permanent update of the curricula including the National Education System itself.
